Terms and Conditions

1. Introduction and Acceptance

These Terms & Conditions ("Terms") govern your access to and use of the Bitex99 mobile application and related services (the "Services"), operated by Bitex99.in ("Bitex99," "we," "us," "our"), a hyper-local food delivery platform connecting customers, restaurant partners, and delivery partners in small Indian towns.

By creating an account, browsing, or placing an order through the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Services.

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above; continued use of the Services after changes are posted means you accept the updated Terms.

2. Eligibility

The Services are intended for users aged 13 and older. By using the Services, you represent that you meet this age requirement and, where applicable, have the legal capacity to enter into a binding contract. Restaurant and delivery partners must additionally meet the identity, business, and vehicle documentation requirements described in Section 10 and Section 11.

3. Your Account

You are responsible for providing accurate registration information, keeping your login credentials and OTPs confidential, and for all activity that occurs under your account. Notify us immediately at support@bitex99.in if you suspect unauthorized use of your account.

4. Orders and Delivery

• Placing an order through the Services constitutes an offer to purchase, which is accepted once the restaurant partner confirms it.

• Estimated delivery times are approximate and may vary due to traffic, weather, restaurant preparation time, or other factors outside our control.

• Orders may not be cancelled by the customer once the restaurant partner has accepted them.

• Bitex99 facilitates the connection between customers, restaurants, and delivery partners but is not responsible for food quality, preparation, or packaging; we will assist in resolving reported issues where reasonable.
  

5. Payments

Payments are processed through Razorpay, a licensed third-party payment gateway. Bitex99 does not collect or store your card, UPI, or bank account details — see our Privacy Policy, Section 3.6, for details.

• Prices displayed include applicable taxes and fees unless stated otherwise.

• Once food has been prepared or dispatched, payment is generally non-refundable except as set out in Section 6.
  

6. Refunds and Cancellations

• Refunds may be issued only where:

• the restaurant partner cancels the order;

• delivery is not possible for reasons attributable to Bitex99 or the delivery partner; or

• The wrong or damaged items are received and the claim is verified.

• Approved refunds are processed to the original payment method within 5–7 working days. Bitex99 reserves the right to decline refund requests that appear fraudulent or that fall outside these criteria.
  

7. Promotions and Offers

Promotional codes, discounts, and offers are subject to specific terms communicated at the time of the offer, may be withdrawn or modified at any time, and may not be combined unless explicitly stated. Misuse of promotional offers (e.g., creating multiple accounts to claim a first-order discount) may result in order cancellation, forfeiture of the discount, or account suspension.

8. User Conduct

You agree not to:

• Abuse, harass, or threaten delivery partners, restaurant partners, or Bitex99 staff;

• engage in fraudulent behaviour, including false refund claims or payment disputes;

• misuse promotional offers or referral programs;

• upload false, misleading, or unlawful information; or

• attempt to interfere with the security or proper functioning of the Services.

• Violation of this section may result in suspension or termination of your account under Section 13.
  

9. Restaurant Partner Terms

Restaurant partners must maintain a valid FSSAI license, GST registration (where applicable), and accurate menu, pricing, and availability information at all times. Restaurant partners are responsible for food safety, quality, and packaging, and for fulfilling accepted orders within the timeframes communicated through the Services. Payouts are made to the bank account provided during onboarding, subject to any applicable commission and adjustments for refunds or cancellations attributable to the restaurant.

10. Delivery Partner Terms

Delivery partners must provide valid identity, vehicle, and insurance documentation as described in our Privacy Policy, Section 3.4, and keep this information current. Delivery partners are independent service providers and not employees of Bitex99. Earnings are calculated based on distance and other factors communicated through the delivery partner app and paid out to the registered bank account. Delivery partners must comply with applicable traffic and road safety laws while performing deliveries.

11. Intellectual Property

All trademarks, logos, branding, app design, and content made available through the Services belong to Bitex99 or its licensors. You may not copy, reproduce, or use these except as necessary to use the Services as intended.

12. Limitation of Liability

• To the fullest extent permitted by law, Bitex99 is not liable for:

• Food preparation, quality, or safety issues caused by restaurant partners;

• Delays or failures caused by traffic, weather, or other factors outside our reasonable control;

• Failures or outages caused by third-party services (e.g., Razorpay, Fast2SMS, mapping data providers); or

• Indirect, incidental, or consequential damages arising from use of the Services.

• Nothing in these Terms excludes liability that cannot be excluded under applicable Indian law.
  

13. Account Suspension and Termination

We may suspend or terminate any account — customer, restaurant partner, or delivery partner — that violates these Terms, provides false information, or engages in fraudulent or abusive conduct. You may request deletion of your account and associated data at any time using the "Delete Account" option in the app, or via our account deletion page, as described in our Privacy Policy, Section 8.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the courts located at Bitex99's registered place of business.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, technology, or legal requirements. We will post any changes here with an updated "Last updated" date. Please check this page periodically.
